The ex-lawyer for the former president has left her position as New Jersey's top federal prosecutor. This follows a legal ruling that invalidated her legal standing to occupy the role.

Official Departure

US Attorney General, Pam Bondi, announced Habba's resignation on Monday. Bondi stated that the judicial decision made it impossible for Habba to perform her duties.

"Let no one confuse adherence to the ruling as defeat," Habba stated. "This battle will now stretch across the country."

Court Ruling

The departure follows closely on a US appeals court determined that she had been acting without proper authority as the top prosecutor. This ruling is likely to affect numerous prosecutions in the state.

The court ruled that a interim role that did not receive Senate approval violated the statute on vacant positions.

Future Role and Reaction

It was also stated that she will remain at the DOJ as a senior adviser. Habba plans to challenge the decision of the ruling, with hopes of a reversal.

Writing online, she argued that the judiciary "cannot be permitted to second-guess the executive's selection of attorneys entrusted with executing the executive branch's core responsibility of criminal prosecution."

Legal Career

Habba, 41, was initially recruited to Donald Trump's lawyers in recent years. Subsequently, she represented Trump in his hush-money trial in 2024, which resulted in his conviction on multiple felony counts of document fraud.

Earlier, her appointment to the top New Jersey post, Trump had announced he was naming her as his senior adviser during his second administration, labeling Habba as a steadfast ally and a dedicated fighter for justice.
